Further to the changes brought in by the 5th Money Laundering Directive, additional changes have come in as part of the Money Laundering and Terrorist Financing (Amendment) (EU Exit) Regulations 2020. These changes came into effect on 6th October 2020. This 7 page document aims to set out the changes which will be most relevant to law firms and their internal procedures. The requirements of the Money Laundering and Terrorist Financing (Amendment) Regulations 2019 were laid before Parliament on 20th December and came into force on 10th January 2020.

The Money Laundering and Terrorist Financing (Amendment) (EU Exit) Regulations 2020 came into effect on 6th October 2020 and the main amendment is regarding Trusts.

5MLD increased the scope of the trust registration service, requiring that all express trusts are registered in a central national register. Previously, it was only taxable trusts that needed registering. There was a risk that the new regime would require a large number of trusts to be registered, which previously did not need to be registered.
